Privacy Policy
Your privacy matters here. This policy explains what personal data is collected when you visit this website, why, on what legal basis, and what rights you have. It is written to comply with the Swiss revised Federal Act on Data Protection (revFADP) and, where applicable, the EU General Data Protection Regulation (GDPR).
1. Who is responsible
The data controller for this website is:
Melvina Markmann, Zurich, Switzerland Email: [muteandmuse@gmail.com]
For any question about your data or this policy, contact us at the email above.
2. Principles
Personal data is processed lawfully, in good faith and proportionately. Data is collected for clear purposes, kept only as long as needed, and not used in ways incompatible with those purposes. We do not sell your personal data.
3. Data processed when you visit the site
a) Server log data — When you access this website, the hosting provider automatically records technical data necessary to deliver the site and keep it secure. This typically includes your IP address (often shortened/anonymised), the date and time of access, the page requested, the referring page, and your browser and device type.
Purpose: delivering the website, security, troubleshooting, statistical analysis of stability.
Legal basis (GDPR): Art. 6(1)(f) — legitimate interest in a functioning, secure website.
Retention: log data is kept for a short period and then deleted or anonymised.
Hosting provider: [HOSTING PROVIDER NAME], [country]. A data processing agreement is in place where required.
b) Cookies and similar technologies — See the separate Cookie Policy for details. Non-essential cookies and tracking technologies are only set with your consent.
4. Newsletter/community list
If you subscribe to the mute & MUSE newsletter or community updates:
Data collected: your email address [and optionally your name, if you choose to provide it].
Purpose: sending you the newsletter, community announcements and related content.
Process: subscription uses a double opt-in — you receive a confirmation email and must click to activate. This confirms consent and prevents misuse of your address.
Legal basis (GDPR): Art. 6(1)(a) — your consent. Under revFADP, processing is based on the relationship you have chosen to enter.
Email service provider: [EMAIL TOOL — e.g. Mailchimp / Substack / Kit / Buttondown], which processes the data on our behalf. [If outside Switzerland/EU: data may be transferred to and stored in [country], on the basis of standard contractual clauses or an equivalent safeguard.]
Withdrawal: you can unsubscribe at any time via the link in every email, or by contacting us. Withdrawal does not affect processing carried out before withdrawal.
5. Contact
If you contact us by email or through a contact form, the data you provide (name, email, message content) is processed solely to handle your enquiry. Legal basis: Art. 6(1)(b) GDPR or Art. 6(1)(f). This data is kept as long as needed to deal with your request and any follow-up, then deleted.
6. Third-party services and embedded content
The site uses the following third-party services. Each provider may receive technical data (such as your IP address) when its content loads. Keep only what you actually use.
[Web fonts — e.g. Google Fonts]: if fonts are loaded externally, the provider receives your IP address. To avoid this, self-host fonts — recommended. Legal basis: Art. 6(1)(f).
[Analytics — e.g. Plausible / Fathom / Google Analytics]: used to understand how the site is used. [If cookieless: this tool does not use cookies and does not collect personal data; no consent required.] [If Google Analytics: this tool sets cookies and is only loaded after you consent.]
[Instagram / YouTube / Spotify / SoundCloud embeds]: pages embedding posts, videos or audio load content from these platforms, which receive technical data and may set their own cookies. Where non-essential, they load only after consent. The platforms' own privacy policies apply.
[Hosting / CDN — e.g. Vercel, Netlify, Cloudflare]: delivers and protects the site; processes server data as described in Section 3(a).
7. International data transfers
Some providers may store or process data outside Switzerland and the EU/EEA — for example in the United States. Where this happens, transfers are based on appropriate safeguards (such as EU standard contractual clauses, the Swiss addendum, or a recognised adequacy decision).
8. Your rights
Under the revFADP and the GDPR, you have the right to: access your data and receive a copy; rectification of inaccurate data; erasure where there is no overriding reason to keep it; restriction and objection, including to direct marketing; data portability (GDPR); and to withdraw consent at any time without affecting prior lawful processing.
To exercise any of these, email [muteandmuse@gmail.com]. You also have the right to lodge a complaint — in Switzerland with the Federal Data Protection and Information Commissioner (FDPIC / EDÖB), and in the EU with your local supervisory authority.
9. Data security
Reasonable technical and organisational measures are taken to protect your data against loss, misuse and unauthorised access — including encrypted transmission (HTTPS). No internet transmission is ever completely secure, and absolute protection cannot be guaranteed.
10. Children
This website is not directed at children. We do not knowingly collect data from children under 16. If you believe a child has provided data, contact us and it will be deleted.
11. Changes
This policy may be updated to reflect changes in the website, our tools or the law. The current version always applies; the date below shows when it was last revised.
